Digital Services Act (DSA)

 

Consumer safety and protection are core values of REPSOL IMPACTO SOCIAL (REPSOL SOCIAL IMPACT) and, as an intermediary services provider, we are committed to abiding by the Digital Services Act¹ (DSA). For the purpose of contributing to a transparent and secure online environment, REPSOL IMPACTO SOCIAL has committed to creating a Platform that respects and protects consumers.

1. DATA TRANSPARENCY

REPSOL IMPACTO SOCIAL makes every effort to make available all information on the workings of Motor Verde Marketplace (Green Engine) for the following purposes:

  1. Once a year, REPSOL IMPACTO SOCIAL drafts a report on all content moderation activity taking place during the year clearly and understandably.
  1. Motor Verde Marketplace is designed so you can make free and fully informed decisions.

  2. REPSOL IMPACTO SOCIAL has internal notification procedures to alert Motor Verde Marketplace users in the event an unlawful service has been acquired. Should this occur, all users having acquired the service within the six months prior to the moment in which REPSOL IMPACTO SOCIAL became aware of the illegality will be duly notified thereof.

2. SECURITY AND CONTENT MANAGEMENT

REPSOL IMPACTO SOCIAL is firmly committed to erradicating all unlawful content, for which purpose an internal procedure exists to detect and delete such content.

On the Motor Verde Platform, the following is considered prohibited and therefore constitutes misuse:

  • Accessing the Marketplace from unsecured devices and not using adequate payment and communication providers (internet access, telephone, etc.). REPSOL IMPACTO SOCIAL will not be held liable for the services of these or other third-party providers.
  • Infecting the Marketplace with any kind of malware that could be damaging to REPSOL IMPACTO SOCIAL or any third party.
  • Impersonating another person to gain access to the Marketplace.
  • Using payment methods that are fake or lacking funds, thereby undermining the purpose of the Marketplace.
  • Using the Portal in a manner that infringes applicable regulations, this Legal Notice, or that works against the legitimate interest of REPSOL IMPACTO SOCIAL.
  • Modifying or eliminating by any means the security, protection, or identification devices established by REPSOL IMPACTO SOCIAL or its legitimate owners.
  • Using the Marketplace to distribute unlawful content that could generate confusion.

Should any of the aforestated circumstances occur, REPSOL IMPACTO SOCIAL reserves the right to suspend the processing of notifications and claims sent through notification and action mechanisms and internal claim management systems for a reasonable period of time and after providing a warning.

REPSOL IMPACTO SOCIAL has equipped Motor Verde Marketplace with adequate and proportionate safeguards to guarantee the service has an elevated degree of privacy, security, and protection for minors. REPSOL IMPACTO SOCIAL does not display advertisements based on profiles created with users' personal data, including that of minors.

3. NOTIFICATIONS

If you wish to communicate any question or query to REPSOL IMPACTO SOCIAL or report any content on Motor Verde Marketplace you believe to be unlawful, you may do so via the Repsol Foundation Compliance Channel, available through this link: https://secure.ethicspoint.eu/domain/media/en/gui/110218/index.html. Please indicate in the form location section that your message is regarding the Motor Verde Platform.

REPSOL IMPACTO SOCIAL will give your message its full attention, providing the corresponding person or entity with confirmation of its reception and proceeding to resolve the matter without undue delay, diligently, not arbitrarily, and objectively, also notifying its decision regarding the information reported.

REPSOL IMPACTO SOCIAL is aware of the need to eliminate all unlawful content, for which reason we will proceed to delete any content in violation of the Motor Verde terms and conditions.

Should REPSOL IMPACTO SOCIAL be made aware of any information suggesting that a criminal act involving a threat to the life or security of one or more people has been committed, is being committed, or will likely be committed, this suspicion will be immediately reported to the law enforcement or judicial authorities in the affected Member State or Member States along with all the pertinent information available.
